Call to Order

Roll Call

Approval of Minutes: The meetings of the Committee held November 21 and 22, 2011, were recorded via verbatim transcript and video tape. Each member of the Committee has received a copy of the verbatim transcript. Therefore, the approval of the minutes of said meetings will relate to said verbatim transcript.

Business:

1. Continuation and Conduct of Hearing Regarding:

In the Matter of the Charges Filed by: Gary Byers, Complainant,
Against Village of Palmyra Chief Charles Warren, Respondent.

The Hearing shall continue and be conducted pursuant to Rules of Procedure for Hearing Before Police Committee and Section 62.13(5), Wis. Stats.

2. Committee’s Acknowledgment of Receipt of Materials Subsequent to Completion of Evidentiary Hearing on November 22, 2011:

A. Received Closing Argument of Complainant Brief
B. Received Motion to Dismiss of Respondent
C. Received Complainant’s Reply to Respondent’s Motion to Dismiss
D. Received Hearing Examiner’s Recommendation for Determination

3. Final Closing Argument by Complainant – Mr. Gary Byers

4. Final Closing Argument by Respondent – Chief Charles Warren or Attorney Paul Bucher

5. Committee Deliberations:

A. Motion to Move Into Closed Session.

This portion of the meeting may, upon proper motion and procedure, be considered in closed session pursuant to §§ 19.85(1)(a), (b) and (f), Stats., and Rules 5(a) and 6(a) of the Rules of Procedure for Hearing Before the Police [Committee], for purposes of: deliberating concerning a case which is the subject of a quasi-judicial hearing before the Police Committee; considering dismissal, demotion or discipline of a public employee, and the taking of formal action on such matter; and considering personal histories or disciplinary data of specific persons, the investigation of charges against specific persons, which, if discussed in public, would be likely to have a substantial adverse effect upon the reputation of any person referred to in such histories or data, or involved in such investigation. The Committee may vote to reconvene in open session following the closed session, for purposes of completing deliberations and/or rendering its decision on the merits of the matter that was the subject of the hearing.

B. Committee Determinations:

a. Whether just cause exist, by substantial evidence, to sustain the charges related to:

1) The “Child Enticement Case”

2) The “Marijuana Case”

3) The “Drug Overdose Case”

b. If so, the appropriate and commensurate penalty to be imposed.

C. Motion to Move Into Open Session.

6. Announcement of Committee’s Determinations

7. Request to Parties to Waive 3-Day Filing Requirement of Rule 6 and of § 62.13(5)(f), Stats.
